Double rental reform: what landlords and investors need to know

The Government has approved two new Royal Decree-Laws that once again overhaul the rental market in Spain.
Following the repeal by Parliament of Royal Decree-Laws 26/2026 and 27/2026, the Council of Ministers approved, on 6 October, Royal Decree-Law 29/2026, which came into force on 8 October, and Royal Decree-Law 28/2026, which will come into force on 15 November. Both also affect contracts that have already been signed. The key points:
- Mandatory extension of 5 or 7 years upon expiry of the minimum term of the tenancy agreement, subject to 6 months’ notice from the landlord (RDL 28/2026).
- Minimum compensation of 12 months’ rent, calculated on the basis of the higher value of the state reference price index, if the landlord does not renew the tenancy (RDL 28/2026).
- Notices of termination sent from 7 October onwards are now eligible for compensation (RDL 28/2026).
- Evictions suspended until 2030 in certain cases of vulnerability (RDL 29/2026).
- A 2 per cent cap on rent increases until the end of 2027 (RDL 29/2026).
- Seasonal and room-by-room lettings brought under control, with new rules to prevent fraud (RDL 29/2026).
Both regulations must be ratified within 30 days by the Standing Committee of Parliament and leave certain issues unresolved that may end up in court.
