Six months after municipalities were required to adapt their rubbish collection fees to Law 7/2022 on waste and contaminated soil, some councils have already begun to charge the new fee, giving rise to several questions about its application.

In an article published by Diario EL PAÍS, Nuria Estévez, associate lawyer in Lener's Tax and Fiscal Department, explains who should bear this payment — the owner or the tenant — and how it should be correctly reflected in rental contracts.

Although the owner is liable to the local council, they can pass on the cost to the tenant, and it is advisable to expressly state this obligation in the contract.
