We continue to explore the new era of data in Europe through practical case studies.
Lener's Information Security and Data Protection department analyses how the DataAct democratises access to data and transforms the relationship between users, businesses and the public sector. Some illustrative examples:
1️⃣ A user of a smart washing machine will be able to request usage data from the manufacturer and share it with an independent technical service of their choice.
2️⃣Vehicle owners will have the right to access their car's data and transfer it to a non-official repair shop, gaining freedom and access to more competitive repairs.
3️⃣In a health crisis, authorities may request mobility data from transport companies to manage lockdowns, or information from vehicle rental platforms about their fleets to coordinate evacuations.
4️⃣A technology SME negotiating with a large multinational will not be forced to accept unfair terms for transferring its data, as it will be able to rely on model clauses proposed by the EU that guarantee fair conditions.
5️⃣If a European company uses a cloud service managed by a US-based company, the provider will not be able to transfer the data to US authorities if the request is contrary to the European legal framework.
Beyond these examples, the Data Act poses significant technical, legal, and organisational challenges that will require affected entities to conduct a preliminary analysis of the situation and develop a strategic plan to ensure regulatory compliance.
