The Faster Directive: a key step for cross-border investment efficiency

Patricia Miralles, partner of the Fiscal and Tax Department, analyzes in @El Confidencial the impact of the recently approved Faster Directive, which seeks to streamline the refund of withholding taxes on international investments and strengthen the control mechanisms against fraud, ensuring a more secure framework for Member States.

The Directive rests on three main pillars:

• Automated and harmonized EU-wide digital tax residence certificate, to be issued within a maximum of 14 days from its request.
• New procedures: States will be able to choose to apply the correct withholding tax at the time of payment (relief at source) or allow a fast refund within a maximum of 60 days (fast refund).
• Certified financial intermediaries: Credit institutions and other key players in the payment chain will assume a central role in the identification of the beneficial owner and compliance with the requirements of the Directive.
