17 October 2024 marked the deadline for EU Member States to transpose the NIS 2 Directive into their national legislation. The directive aims to strengthen European cyber resilience, harmonise protection standards and improve the response to increasingly sophisticated digital threats.
One year later, Spain is still in the process of transposing the NIS 2 Directive through the Draft Bill on Cybersecurity Coordination and Governance, approved in January 2025, but still pending completion.
In this context, Sofía García, a lawyer in the Information Security and Data Protection area at Lener, analyses in Cinco Días the challenges arising from this delay and the urgency of consolidating an effective regulatory framework that provides legal certainty and strengthens the country's response capacity to cyber incidents.
