Notaries handle particularly sensitive information under increasingly stringent regulatory oversight. The digital transformation of the sector and the introduction of AI into notarial practice have heightened the risk of improper data processing, loss of control over data, and a real reputational and financial impact for those who are unprepared.
Between 2022 and 2024, the Spanish Data Protection Agency (AEPD) has launched investigations into notaries’ handling of biometric, land registry and documentary data, with fines of up to €10,000 per case. The regulatory framework allows for fines of up to €20 million or 4 per cent of total annual turnover.
