En esta nueva edición de Newsletter, recopilamos algunas de las resoluciones más relevantes dictadas en los últimos meses por el Tribunal Supremo y los Tribunales Superiores de Justicia en materia de responsabilidad sanitaria.

Las sentencias seleccionadas analizan cuestiones clave para la práctica, como el consentimiento informado, la pérdida de oportunidad, el daño desproporcionado, el nexo causal en supuestos de error diagnóstico o deficiencias asistenciales y el cómputo del plazo para el ejercicio de las acciones de responsabilidad. En conjunto, ofrecen criterios de interés para delimitar los supuestos de responsabilidad sanitaria y las obligaciones de los profesionales y centros sanitarios.

Judgment No. 79/2026 of the Civil Section of the Court of First Instance of Madrid (Court No. 103), of 26 March: Obstetric malpractice for failure to detect progressive fetal hypoxia during delivery.

The claim is upheld in full, the court finding that the lack of monitoring and incorrect interpretation of fetal monitoring, together with an inadequate vacuum extraction, resulted in intrapartum hypoxia that caused severe neurological sequelae to the minor.

STS 493/2026, of 6 April 2026: Informed consent must be tailored to the patient's specific clinical circumstances and reflect their actual expectations of success.

The Supreme Court rules on the appeal lodged in proceedings claiming damages arising from a pulmonary vein ablation procedure performed to treat the arrhythmia suffered by the patient.

STS 750/2026, of 14 May 2026: A review of the degree of disability does not delay the commencement of the limitation period where the injured party was already aware of the extent of their sequelae.

The judgment resolves a healthcare liability claim arising from a neurosurgical procedure in which the claimant sought compensation in excess of EUR 800,000 for the damages suffered, alleging a diagnostic error that had led to unnecessary surgery.

STSJ Galicia 2100/2026, of 26 March 2026: Disproportionate harm may be found even where no technical error in the procedure is established.

The Chamber examines a claim brought by a patient who underwent surgery to correct urinary incontinence through the implantation of a suburethral mesh.

STSJ Catalonia 683/2026, of 18 May 2026: The existence of a technical fault in a diagnostic test does not, in itself, determine liability.

The Chamber rules on a case concerning the oncological follow-up of a patient with a history of breast cancer. The claimant argued that a mammogram had a technical defect that prevented the detection of a tumor recurrence, which was diagnosed sixteen days later at another hospital.
