Noa Rodríguez Fernández, partner in charge of Lener's Litigation and Arbitration practice, participates in a report in Cinco Días on the practical application of ADR one month after its entry into force.
The economic newspaper Cinco Días has published an article entitled ‘Obliged to negotiate: one month of ADR’, in which it analyses the impact of the new procedural reform that requires proof of a real attempt at out-of-court dispute resolution, through the so-called appropriate means of dispute resolution (ADR), before filing a civil or commercial lawsuit.
Noa Rodríguez has contributed her vision as an expert in the procedural area. In her speech, she emphasised that the firm has already handled claims under the new legal framework, using tools such as notarial conciliation, binding offers and direct negotiation, depending on the nature of the case. He also underlines the importance of carrying out educational work with clients in order to select the most appropriate means in each specific case: ‘For technical issues, we may opt for the opinion of an independent expert; for financial disagreements, conciliation or mediation may be more advisable,’ he explains.
Lener's participation in this report demonstrates the firm's commitment to its clients to facilitate the proper implementation of the new mechanisms required by Organic Law 1/2025 on the efficiency of the Public Justice Service.
